Survey of Waqf Properties:- The State Govt. by its notification No.843 dt. 15-09-2008 appointed the Principal Secretary of the Revenue and Land Reforems deptt. as survey commissioner, the collectors of the districts as additional survey commissioner and all the D.C.L.R. as assistant survey commissioner to get the waqf properties surveyed U/S 4 of the Waqf Act 1995. It is proposed to do the survey work by outsourcing with the help of district administration, (DM, DCLR and COs.). The Survey work is in progress. The Principal Secretary, Revenue and L.R, Secretary Department of Minority Welfare, Govt. of Bihar periodically review the progress of work. The state govt. has sanctioned and amount of Rs. 29 lacks, for servey and Computrization of Waqf records.

The Waqf Tribunal:- Name of the Presiding Officer – Mr. Akram Rizvi, The State Govt. has constituted a Waqf Tribunal U/S. 83 of the Waqf Act, 1995 for determination of any dispute or other matter relating to waqf property. The Tribunal is functioning. The state Govt. has also taken legislative measures to transfer all cases of waqfs, pending before the different civil courts, in the Waqf Tribunal for speedy disposal by an amendment called the Waqf (Bihar amendment) Act. 2006 (Annex. No. 01). There are about 150 cases the Waqf Tribunal.

The word "Waqf" has its origin in the Arabic word "Waqufa" meaning thereby to detain or to hold or tie up. It is said that once second Khalifa Omar acquired a piece of land in Khaibar and asked the prophet Mohammed as how best to to make the most pious use of it. The prophet said "Tie up the property and devote the usufruct to the welfare of human beings, and it is not to be sold or made the subject of gift or inheritance , devote its produce to your children , your kindred and the poor and in the way of Allah".

The Waqf Act 1995 defines the WAQF as the permanent dedication by a person professing Islam, of movable or immovable property for any purpose recognized by the Muslim law as pious, religious or charitable Waqf" means the permanent dedication by a person professing Islam, of any movable or immovable property for any purpose recognized by the Muslim law as pious, religious or charitable and includes :
